Release & Waiver of Liability

In consideration of being allowed to participate in any way in events and activities at Legacy Dry Creek Ranch, LLC, I hereby acknowledge and agree that:

THE RISK OF INJURY FROM HUNTING, SHOOTING, AND OTHER EVENTS AND ACTIVITIES AND/OR THE USE OF THE RELATED BUILDINGS, STRUCTURES, EQUIPMENT, AUTOMOBILES, FIREARMS, WEAPONS, ATVS, BOATS, TREE STANDS, ROADS, BODIES OF WATER, LAND, AND ALL OTHER REAL OR PERSONAL PROPERTY AT LEGACY DRY CREEK RANCH IS SIGNIFICANT, INCLUDING THE RISK OF PERMANENT PARALYSIS OR DEATH, AND WHILE PARTICULAR RULES, POLICIES, EQUIPMENT, AND PERSONAL DISCIPLINE MAY REDUCE THIS RISK, THE RISK OF SERIOUS INJURY DOES EXIST. I ACKNOWLEDGE AND AGREE THAT THE USE OF FIREARMS AND OTHER WEAPONS BY MYSELF OR OTHERS ON CLUB PREMISES OR OTHERWISE ARE INHERENTLY DANGEROUS AND HIGH-RISK ACTIVITIES AND I KNOWINGLY AND FREELY ASSUME SUCH RISKS, BOTH KNOWN AND UNKNOWN, EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASEES OR OTHERS, AND ASSUME FULL RESPONSIBILITY FOR MY PARTICIPATION.

YOUR SAFETY IS OUR PRIMARY CONCERN. WE EXPECT YOU TO FOLLOW SAFE GUN HANDLING AND HUNTING PROCEDURES. WE REQUIRE EVERYONE TO WEAR SAFETY GLASSES, HEARING PROTECTION, AND A BLAZE ORANGE HUNTING CAP, VEST OR JACKET WHEN APPROPRIATE. FOR YOUR SAFETY AND THE SAFETY OF YOUR HUNTING COMPANIONS, NO ALCOHOL OR DRUG CONSUMPTION IS ALLOWED WHILE HUNTING OR SHOOTING. HUNTING CAN BE PHYSICALLY DEMANDING. WE EXPECT YOU TO KNOW YOUR PHYSICAL LIMITATIONS.

I agree to conduct all hunting activities in accordance with Arkansas legal hunting season dates. All hunters must carry valid Arkansas hunting licenses and appropriate signed stamps on their person while engaging in hunting activities. I will not use the land for any unlawful, disreputable, or ultra-hazardous purpose nor conduct my activities in a manner constituting a nuisance of any kind.

In the event that I should require medical care or treatment, I agree to be financially responsible for any costs incurred as a result of such treatment. I am aware and understand I should carry my own health, personal property, automobile, and liability insurance.

In the event that any damage to equipment, facilities, or other property of Legacy Dry Creek Ranch, LLC occurs as a result of my or my family’s or guests’ willful actions, negligence, or recklessness, I acknowledge and agree to be responsible for any and all costs to repair such damage, including costs of collection and attorneys’ fees, if incurred.

In full recognition of the foregoing, I hereby release, waive and forever discharge Legacy Dry Creek Ranch, LLC, its owners or employees, and/or people with whom they may contract for services, including all landowners and leasees (“Releasees”), from any and all liability to the undersigned, my spouse, legal representatives, heirs and assigns, for any and all loss, claim, or damages resulting from my participation in events and activities at Legacy Dry Creek Ranch, on account of injury to me or my property, even injury resulting in death, whether arising from the negligence of the Releasees or otherwise, to the fullest extent permitted by law. This release and waiver is complete as it is my intent to hold harmless and indemnify Releasees for any injury or property damage that might result while I am involved in the sport of hunting conducted by Legacy Dry Creek Ranch, LLC, its owners or employees, or while on its premises, leases or subleases.

The undersigned assumes full responsibility for the risk of bodily injury, death, or property damage due to my voluntary participation in events and activities at Legacy Dry Creek Ranch, LLC and agrees to indemnify the Releasees and hold them harmless from any and all liability, damages, or costs, including attorneys’ fees, resulting from my voluntary participation in activities and events at Legacy Dry Creek Ranch, LLC. The undersigned agrees this release, waiver, and indemnification agreement is intended to be as broad and inclusive as permitted by the laws of the state of Arkansas and to hold harmless Legacy Dry Creek Ranch, LLC, its owners or employees, and/or people with whom they may contract for services, including all landowners, for any accidents or incidents that may occur on its premises, leases or subleases.

I HAVE READ THIS RELEASE OF LIABILITY, INDEMNIFICATION, AND ASSUMPTION OF RISK AGREEMENT, FULLY UNDERSTAND ITS TERMS, AND SIGN IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT. Anyone underage must always have adult supervision and their parent/guardian must complete the minor release form below.
